Status: July 2026. These are the general terms and conditions for the Zahn Kumpan portal. This English page is an international-facing adaptation of the German AGB; the German version prevails in case of doubt. This wording is draft text pending review by a German lawyer before production use.

These General Terms and Conditions (Allgemeine Geschäftsbedingungen, "AGB") govern the use of the Zahn Kumpan portal at portal.zahn-kumpan.de (the "Portal"), operated by Beratung für Digitalisierung - Kumpan GmbH, Wilhelmshavener Straße 41, 10551 Berlin ("Zahn Kumpan", "we", "us").
Zahn Kumpan is a brand of the aforementioned company. Contact details and the responsible managing director are set out in the Imprint.
These terms apply to the relationship between Zahn Kumpan and the Users of the Portal. They do not govern any separate contract that a User may conclude directly with a listed Partner.
Conflicting or supplementary terms of the User do not become part of the contract unless Zahn Kumpan has expressly agreed to them in writing.
The following terms are used throughout these AGB:
Zahn Kumpan operates an information and comparison portal for dental practices. Its purpose is to help practices assess their digitalization and modernization status and to compare pre-researched service providers, initially in the external-billing category.
Zahn Kumpan acts solely as an intermediary and information platform. Zahn Kumpan itself does not provide the services offered by the Partners (for example external billing, software, or agency services) and does not become a party to any contract that the User concludes with a Partner.
The recommendations produced by the onboarding quiz and the comparison content are provided for information and orientation purposes only. They do not constitute legal, tax, medical, or other professional advice, and they are no substitute for the User's own examination and decision.
Use of the Portal is free of charge for dental practices. There is no obligation for Users to conclude a contract with a Partner.
Zahn Kumpan finances the Portal through referral commissions paid by Partners when a Lead is forwarded and, where applicable, when a contract is concluded between a Partner and a Practice. These commissions are paid by the Partners and do not increase the price a Practice pays a Partner.
Zahn Kumpan curates comparisons honestly and independently of the individual commission amount. Where a listing is based on a commercial partnership, this is disclosed in accordance with applicable law.
The Portal is intended exclusively for entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), in particular dental practices and their authorized staff. It is not directed at consumers within the meaning of Section 13 BGB.
By registering, the User confirms that they use the Portal in the course of their commercial or independent professional activity and that they are authorized to act for the practice they represent.
Certain functions of the Portal, such as the personalized dashboard and submitting a consultation request, require a user account. Registration is completed via the sign-up process using a valid email address.
The User must provide truthful and complete information during registration and keep it up to date. Access credentials must be kept confidential and must not be passed on to unauthorized third parties.
The User is responsible for activity carried out under their account. If there are indications that an account has been misused, the User must inform Zahn Kumpan without undue delay.
The onboarding quiz collects self-reported information about the Practice and calculates a practice-maturity score together with a prioritized list of recommendations.
The score and recommendations are generated automatically from the answers provided and reflect general rules, not an individual assessment of the Practice. Zahn Kumpan does not warrant that they are complete, accurate for every situation, or suitable for a particular purpose.
Comparison content is compiled with care from publicly available sources and information provided by Partners. Editorial fields such as pricing and quality scores are reviewed by Zahn Kumpan before they are presented as an editorial assessment.
Where third-party ratings (for example public star ratings) are shown, they are marked as such and are not presented as Zahn Kumpan's own verdict.
Zahn Kumpan does not warrant that listings are always complete, current, or free of error, and reserves the right to add, change, or remove listings at any time.
A User may submit a consultation request for a selected Partner. A Lead is created only after the User has actively confirmed the separate lead-processing consent shown in the form.
By submitting the request, the User instructs Zahn Kumpan to store the submitted details and forward them to the selected Partner so that the Partner can respond to the request. The Partner may contact the User directly regarding the request.
The data forwarded may include, in particular:
Any contract about a Partner's services is concluded exclusively between the User and the Partner. Zahn Kumpan is not a contractual party and assumes no obligations arising from that contract.
Zahn Kumpan is not responsible for the performance, quality, timeliness, or lawfulness of a Partner's services, nor for whether or how a Partner contacts the User after a Lead has been forwarded.
Complaints, warranty claims, and other rights relating to a Partner's services must be asserted directly against the respective Partner.
Users may be invited to submit a review after a closing with a Partner. Reviews must be honest, based on the User's own experience, and must meet the minimum quality requirements stated in the review form.
Reviews are checked manually before publication. Zahn Kumpan may refuse to publish, or may remove, reviews that are unlawful, misleading, offensive, or that infringe third-party rights.
Where a Vertrauenswerk reward is offered for a qualifying review, it is granted subject to the conditions communicated at the time of the invitation. A reward is offered for an honest review irrespective of rating, may require a timely claim, and cannot be paid out in cash. There is no legal entitlement beyond those conditions.
When using the Portal, the User undertakes in particular:
Zahn Kumpan endeavors to keep the Portal available but does not warrant uninterrupted or error-free operation. Availability may be limited by maintenance, technical faults, or factors outside Zahn Kumpan's control.
Zahn Kumpan may further develop, change, or discontinue functions of the Portal, provided this is reasonable for the User.
The Portal, its content, design, texts, comparison data, and software are protected by copyright and other intellectual-property rights and remain the property of Zahn Kumpan or its licensors.
The User is granted a simple, non-transferable right to use the Portal for its intended purpose. Any other use, in particular reproduction, distribution, or commercial exploitation of content, requires the prior written consent of Zahn Kumpan, unless mandatory law permits it.
Zahn Kumpan is liable without limitation for damage arising from injury to life, body, or health caused by a breach of duty by Zahn Kumpan or its legal representatives or vicarious agents, and for damage caused intentionally or by gross negligence.
For slight negligence, Zahn Kumpan is liable only in the event of a breach of a material contractual obligation (an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance the User regularly relies). In that case, liability is limited to the foreseeable damage typical for this type of contract.
Any further liability is excluded. Liability under the German Product Liability Act (Produkthaftungsgesetz) and under any guarantee expressly given by Zahn Kumpan remains unaffected.
Because the Portal is free of charge and Zahn Kumpan acts only as an intermediary, Zahn Kumpan is in particular not liable for the services of Partners or for decisions the User takes on the basis of the information provided.
Zahn Kumpan processes personal data in accordance with the GDPR and applicable German law. Details of the processing, the cookie and tracking consent model, and the separate lead-processing consent are set out in the Data Protection notice.
Cookie/tracking consent and lead-processing consent are two separate permissions. Rejecting optional tracking does not prevent a User from submitting a consultation request.
The use relationship is concluded for an indefinite term and can be terminated by either party at any time.
The User may delete their account at any time. Zahn Kumpan may terminate the use relationship with reasonable notice, and may block or delete an account for good cause without notice, in particular in the event of a serious breach of these AGB.
Statutory retention obligations and the documentation of consent for Leads already created remain unaffected by the deletion of an account.
Zahn Kumpan may amend these AGB with effect for the future where this is necessary, for example due to changes in the service, in the legal situation, or in case law, and where the change is reasonable for the User taking into account Zahn Kumpan's interests.
Users will be informed of material changes in an appropriate manner before they take effect. The current version applicable at the time of use governs the use of the Portal.
These AGB and the use of the Portal are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
Where the User is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these AGB is the registered seat of Zahn Kumpan, insofar as this is legally permissible.
The European Commission provides a platform for online dispute resolution at http://ec.europa.eu/consumers/odr. Zahn Kumpan is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
Should individual provisions of these AGB be or become invalid, the validity of the remaining provisions is not affected.
